Section 106 Agreements and Affordable Housing
Planning obligations under Section 106 of the Town and Country Planning Act 1990 (as amended), commonly known as S106 agreements, are a mechanism which make a development proposal acceptable in planning terms, that would not otherwise be acceptable. An agreement is made with the local planning authority in which you agree to pay money or provide affordable housing in order to get planning permission. Sometimes what is called a unilateral agreement is used. Unilateral Agreements are almost identical to Section 106 Agreements. They are sometimes referred to as unilateral undertakings.
Section 106 agreements from both County Council and Pembrokeshire Coast National Park planning applications are managed and monitored by the County Council's Planning Obligations Monitoring Officer, who can be contacted by email: planningobligationsmonitoring@pembrokeshire.gov.uk
Affordable Housing Contributions Map
Affordable housing contributions from both National Park and County Council planning applications are managed and monitored by the link below opens an interactive map, which aims to provide transparency on the collection and use of monetary affordable housing contributions. The map represents each contribution as a 'spend area' in terms of community council's coverage; is broken down into what has been spent and what has not; and provides details (where applicable) of how a contribution has been spent. The map is collaboration between the National Park Authority and the County Council and details contributions from planning applications submitted to both planning authorities. The map will be developed over time as new applications come in and contributions from previous applications have been spent.
A framework to determine the use of contributions received for affordable housing was agreed by PCCs Cabinet on the 22nd February 2016. A copy of the report is available here:

Adopted Local Development Plan
On the 28th February 2013, the Council adopted a Local Development Plan (LDP) for Pembrokeshire (excluding the area of the Pembrokeshire Coast National Park).
The end date for the current Pembrokeshire County Council Local Development Plan (LDP), adopted on 28/02/2013
On 24th September 2020, Julie James, AS/MS, Minister for Housing and Local Government (and subsequently Minister for Climate Change since May 2021), wrote to all Local Authorities and National Park Authorities in Wales regarding end dates for LDPs.
She advised that:
‘The provision in the PWA (Planning Wales Act) 2015 regarding the period to which a plan has effect were commenced on 4th January 2016. These provisions do not apply to LDPs adopted prior to this date. Plans adopted prior to 4 January 2016 will remain the LDP for determining planning applications until replaced by a further LDP. For those LDPs adopted after 4 January 2016, the plan will cease to be the LDP on expiry of the period specified in the plan’.
For Pembrokeshire County Council, the current LDP (LDP 1) was adopted on 28/02/2013, which in the context of the Minister’s letter means that it will remain in force until LDP 2 (the replacement plan) is adopted.
Therefore, the part of the Plan title saying ‘up to 2021’ should be disregarded.

Pembrokeshire County Council Local Development Plan Landscape Character Assessment Supplementary Planning Guidance Consultation: 22nd February – 26th May 2023
This second draft Landscape Character Assessment forms part of the evidence base for LDP2. It is also being consulted on as draft Supplementary Planning Guidance to the Local Development Plan (adopted 2013).
A previous version of the draft Landscape Character Assessment was consulted on in July 2019 The document has been updated to reflect the latest national planning policy in Future Wales - The National Plan 2040 (Welsh Government), and the latest landscape guidance and good practice.
The consultation is running for 3 months and will close at 4.30pm on 26th May 2023.

Local Development Plans (LDPs) contain policies and proposals that provide a basis for decision-making on planning applications and for framing conditions on consented applications. The Council's LDP was adopted on 28th February 2013.
Supplementary Planning Guidance (SPG) sets out more detailed guidance on the way in which policies of the LDP will be applied in particular circumstances or areas.
SPG does not form a part of the Council's LDP, but it is consistent with its provisions and is cross-referenced to appropriate policies and / or proposals of the LDP.
Only LDP policies and proposals have special status (primacy) in decision-making on planning applications. However, once adopted, SPG may be taken into account as a material consideration in the determination of planning applications.

Good Practice Advice Notes
In addition to Supplementary Planning Guidance (SPG), Pembrokeshire County Council has also produced a number of good practice advice notes, listed below, some of which are available online.
Local Development Plan policy GN.1 (General Development Policy), criterion 7, Advisory Note - Safeguarding for planning purposes , December 2014
The advisory note on Safeguarding for Planning Purposes elaborates on one aspect of LDP policy GN.1 (General Development Policy). Criterion 7 of GN.1 requires that development does not cause or result in unacceptable harm to health and safety. Where a safeguarding zone exists and development is proposed within it, advice will be sought from the appropriate safeguarding body. This advisory note provides further information on safeguarding for planning purposes, including sources of further information.
Local Development Plan policy GN.8 - Protection of employment sites and buildings
This Development Management Policy Note supports Local Development Plan (LDP) policy GN.8 on the Protection of Employment Sites and Buildings. It provides guidance to Development Management Officers on criterion 3 of the policy, and paragraph 6.46 of the Reasoned Justification to that policy, specifically focusing on site marketing requirements where a change of use away from employment (Use Classes B1, B2 or B8) is being proposed.
This Policy Note may also be of interest to those proposing to re-develop or use business, general industrial, storage or distribution sites or buildings for other purposes. It has therefore been made available on the planning pages of the Council's web-site.
Local Development Plan policy GN.22 Prior extraction of the mineral resource
Prior extraction refers to the removal of economic mineral resources that are found at or close to the ground surface from development sites, prior to the commencement of construction work. It prevents the unnecessary sterilisation of mineral resources, but there are certain circumstances in which it will not be appropriate.
This good practice guidance note has been prepared for Development Management officers and indicates how the key issues relating to prior extraction of minerals should be dealt with during the evaluation of planning applications.
Anticipating that the guidance note may also be of interest to those proposing development, it has been made available on the planning pages of the Council's web-site.
Cumulative Impact of Wind Turbines on Landscape and Visual Amenity guidance
This Guidance on Cumulative Impact of Wind Turbines on Landscape and Visual Amenity: Pembrokeshire and Carmarthenshire provides interim good practice guidance for applicants, developers, consultees and Council officers in the Pembrokeshire County Council planning area.
Pembrokeshire Good Practice Guidance:Slurry Stores
This guidance has been produced with the support of ADAS, Countryside Council for Wales, Farmers Union of Wales, National Farmers Union, Pembrokeshire Coast National Park Authority and Pembrokeshire County Council with particular thanks to Mr Chris James and Mr David James.
Listed Buildings: Advice to Property Owners
This guidance provides practical information on the use of soft, permeable lime mortars based on lime putty, which are ideal for repairing and repointing the mortar joints of old masonry walls. It does not deal with the use of mortars containing hydraulic lime or lime putty gauged with cement, both of which provide significantly harder and generally less permeable mortars.
It is essential reading for building owners, building contractors and others who are responsible for the care of an old building but do not specialise in the field.
Interim Advisory Note on Development in Town Centres
This interim advisory note provides guidance on the application of planning policy and material considerations when determining planning applications in town centres.
Implementation and Monitoring
The County Council is committed to demonstrating progress with Plan delivery.
As part of the monitoring framework the Council will prepare and publish an Annual Monitoring Report (AMR) with appropriate stakeholder involvement. The AMR is the main mechanism for assessing the relevance and success of this Plan and identifying any necessary actions. It is intended to improve the transparency of the planning process and to inform elected members, the community, business and environmental organisations of Development Plan issues facing the area. Through the AMR the Council will report on the Plan context and the data collected as part of the monitoring and evaluate the effectiveness of the Plan.

Inspector's Report
The Council has received the Inspector's Report on the Pembrokeshire County Council Local Development Plan (for the County but excluding the area of the Pembrokeshire Coast National Park).
The report is titled the ‘Report on the Examination into the Pembrokeshire County Council Local Development Plan Adoption - 2021' and has been submitted by the Inspector to the Council. It is available to view here Inspector`s Report
The Inspector has concluded that, with the recommended changes outlined in his report incorporated into the LDP, the Plan satisfies the requirements of Section 64 (5) of the Planning and Compulsory Purchase Act 2004 and meets the tests of soundness set out in LDP Wales.
The Council must now adopt the Plan - this is required to take place within 8 weeks of the date of receipt of the Inspector's report.
When adopted, the Pembrokeshire County Council Local Development Plan will become the Development Plan for Pembrokeshire (excluding the area of the Pembrokeshire Coast National Park) and will provide a basis for decisions on land use planning in this area. It will supersede the Joint Unitary Development Plan for Pembrokeshire in the parts of the County within the Council's planning jurisdiction.

Pembrokeshire County Council submitted proposals for the Local Development Plan to the National Assembly for Wales in accordance with The Town and Country Planning (Local Development Plan) (Wales) Regulations 2005 (Regulation 22). The LDP Deposit Plan including proposed focussed changes was subject to Sustainability Appraisal, incorporating Strategic Environmental Assessment. The Plan was tested against SA objectives to ensure that it contributes towards sustainable development. The submission documents include the final Sustainability Appraisal Report (Deposit Plan incorporating Post Deposit Changes) which is available below.

In accordance with legislation, the statutory consultees (Countryside Council for Wales, Environment Agency and Cadw) were notified that the SEA is taking place and the decision recorded.
- SA/SEA Screening Report
The first stage of the SA process was to produce a Scoping Report. The report includes a review of baseline information and other plans and programmes considered relevant to inform the emerging LDP. The SA Scoping Report also included sustainability objectives which were used to test the LDP as it progressed.
The SA Scoping Report was consulted on with the three statutory consultees (Countryside Council for Wales, Environment Agency, and Cadw) for a period of five weeks (consultation closed 5 September 2008). Other specific consultees were also consulted. The final agreed SA Scoping Report is available for information. The report was amended to take into account the consultation responses. The Preferred Strategy underwent Sustainability Appraisal, which incorporated Strategic Environmental Assessment. Habitats Regulations Appraisal
In accordance with legislation, the LDP has undergone Habitats Regulations Appraisal (HRA) to determine whether there may be any likely significant effects on European sites designated for their wildlife and habitats (Natura 2000 sites). The potential effects of the LDP alone and in-combination with other plans were considered at various stages during the preparation of the LDP. HRA highlighted where changes could be made to the Plan to ensure that European sites are not impacted. Mitigation measures were also identified. There are 19 European sites in Pembrokeshire or close to the boundary of the Plan area to be considered. An example of a European site in Pembrokeshire is the Afon Cleddau SAC.

The LDP was screened at the outset to identify any potential effects, however, the plan was at an early stage and therefore there were no specific strategies to assess. The statutory consultees were consulted and commented on the Habitats Regulations Appraisal.

The HRA screening predicts the potential effects of the LDP Preferred Strategy on European sites. There was some uncertainty whether the LDP may have a likely significant effect on European sites at this stage. The HRA looked at the plan in detail and assessed the potential effects, both alone and in-combination with other plans and identified necessary changes to the Plan to ensure that European sites were not impacted. Mitigation measures were also identified.

The LDP Deposit Plan has been subject to HRA. The report has concluded that the Plan will not have a likely significant effect on the European sites. The report was available for consultation from 26 January 2011 to 5.00 p.m. on 9 March 2011. The report was amended to take into account the consultation responses.
